These conditions regulate the sale of the services offered on this website by Inversiones Galdana SL, under the trade name of THE MOUNTAINS HOTEL:

Inversiones Galdana S.L. is registered in the Madrid Mercantile Registry under T 7030, f50, S8, H SE129764, and is dedicated to the management and development of all types of tourism.

2. Terms and conditions of use. 

Accessing the website www.themountainshotel.es or making a booking through it implies acceptance of these booking conditions, as well as those contained in the company's privacy policy, and therefore, if you do not agree with any of these conditions, you must refrain from using this website.

These conditions, as well as the content, design and organisation of the website, may be revised and/or modified at any time. In the event of revision or modification of the conditions, their new wording will be immediately published and accessible on the website and will be applicable from that moment. In order to be correctly informed of the conditions in force at any given time, the user must consult them periodically. Use of the website, including access by users and browsing, is free of charge and implies compliance with these terms and conditions, Spanish legislation and good practice and accepted use of the internet.

These conditions are applicable to all users who use the website. However, in the event that, in the future, new sections are included in the website offering specific services, Inversiones Galdana S.L. may include in the same specific conditions applicable to said sections, either taking precedence over or supplementing these conditions.

Although Inversiones Galdana S.L. wishes to provide users with a continuous service through the website, it may be interrupted by various circumstances. In this case, the hotel will try to give its users as much advance notice as possible.

By making a booking on this website, the user warrants that they are over 18 years of age and have the legal capacity to enter into a contract. 

The contract may be formalised, at the user's choice, in any of the languages in which the terms and conditions are available on this website.

In the event that any of the provisions of these terms and conditions are declared null and void, in whole or in part, by any court, tribunal or competent administrative body, such nullity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

The website of Inversiones Galdana S.L.  contains information on its compliance with the relevant codes of conduct or trustmarks, copies of which may be requested from our customer service department through the channels indicated in section eleven of these conditions. 

3. Services offered and purchase procedure. 

The services offered by Inversiones Galdana S.L. will appear on the website, including detailed information about their characteristics and compatibilities.

The procedure for purchasing products from Inversiones Galdana S.L. is as follows:

1. The user must select, from all the categories displayed, the products they wish to purchase and check availability in the calendar. Then click on the corresponding icon [SELECT].
2. Once the chosen product has been selected, click on the [BOOK] button, where the details of the chosen products and the price corresponding to each of them will be included. The price expressed for each product includes the amount of the corresponding Value Added Tax (VAT).
3. In order to formalise the purchase it will be necessary to complete the user's personal data in the contact form of the hosted client, which will be incorporated into the company's database and processed in accordance with the provisions of our Privacy Policy, in order to process the reservation. Before booking, the booking conditions and cancellation policy must be read and accepted. The page will then be redirected to our booking service provider Bookassist, where the customer will have to fill in their financial details (bank card details required), and click on the booking with payment obligation section.
4. Once the booking process has been completed, and within a maximum period of 24 hours, the user will receive an e-mail confirming the order and including all the details of the order. Likewise, the user will be informed in the same email of the cancellation conditions of the reservation.

If the user does not receive the booking confirmation email, they should check their SPAM folder or contact our customer service.

The user must correctly indicate their personal data to avoid incidents when processing the booking. In the event that the user notices any type of error in the reservation once the process has been completed, they should immediately contact our customer service department to correct the error. The user may contact the Hotel's customer service department via the telephone number or e-mail address mentioned in the "contact" section of these terms and conditions. 

If, once the booking process has been formalised, the unavailability of any of the products included in the same is detected, Inversiones Galdana S.L. will inform the user as soon as possible, offering, whenever possible, the replacement of the product with one of the same or similar characteristics at the same price, the proposal of a change of dates, or the full refund of the amounts paid in the event that payment has been made as it is a non-refundable rate. In the latter case, if the user opts for reimbursement, it shall be made without undue delay and, in any case, within fourteen (14) calendar days of the user's communication. The refund will be made by the same means of payment used by the user to place the order, unless otherwise agreed. 

In addition to the case described in the previous paragraph, Inversiones Galdana S.L. may cancel the reservation if it has indications that it may be fraudulent or that the user who has made it is a minor.

Inversiones Galdana S.L. will not assume responsibility if the contract is not completed because the data provided by the user is false, inaccurate or incomplete.

4. Price and payment. 

The prices of the products included on the website are shown in euros and may vary at any time, but such variations shall in no case affect orders that have already been confirmed.

All prices shown on the website include VAT at the rate in force at any given time and depending on the specific item in question. Any change in the VAT rate will be automatically applied to the prices of the products on sale.

In the case of non-refundable rates, when making the reservation, the user expressly authorises Inversiones Galdana S.L. to issue the invoice for the order in electronic format to the e-mail address provided by the user, although they may indicate at any time their wish to revoke said consent or to receive an invoice in paper format by contacting our customer service department at the telephone number or e-mail address mentioned in the "contact" section of these conditions.

The full amount of the booking will be charged to the indicated bank card (credit or debit card, MasterCard or Visa) within 48 hours of booking. For all other offers, payment of the full amount of the stay will be made on the day of arrival. The card will only be charged in the event of non-compliance with the cancellation policy or in the event of non-refundable fares. The charge will be made online through the payment gateway of the corresponding financial institution.

5. Booking Cancellation Policies.

This cancellation policy applies to the valid prices for individual bookings and does not apply to groups and/or special events.

The cancellation policies displayed on this website vary depending on whether it is high season or the rest of the season.

CANCELLATION POLICY FOR HIGH SEASON (22/12/23 - 08/01/24 | 09/02/24 - 29/02/24 | 22/03/24 - 31/03/24):

Free cancellation up to 7 days before the day of arrival. In the event of late cancellation, the following will be charged, taking into account the length of stay of your booking:

• For bookings of less than 5 days, 1 night will be charged.
• For bookings between 5 and 9 days, 2 nights will be charged.
• For bookings of more than 10 nights, 3 nights will be charged. 

CANCELLATION POLICY FOR THE REST OF THE SEASON: 

Free cancellation up to 5 days before the day of arrival. In the event of late cancellation, the following will be charged, taking into account the length of stay of your booking:

• For bookings of less than 5 days, 1 night will be charged.
• For bookings between 5 and 9 days, 2 nights will be charged.
• For bookings of more than 10 nights, 3 nights will be charged. 

For all seasons, in case of no show (the guest does not arrive or cancel the booking) or early departure, the entire stay will be charged.

Payment policy for free cancellation bookings:

• Payment is made directly at the hotel.
• The card is only charged if the cancellation policy is not followed.  

NON-REFUNDABLE RATE CONDITIONS:

This rate requires payment in advance.  

• Cancellations or changes are not permitted when booking this rate.
• Prepayment is required at the time of booking and is non-refundable. 

How to cancel: The confirmation email you receive when you complete your booking will give you full details of how to cancel your booking.

6. Non-existence of the right of withdrawal.

In accordance with the provisions of art. 103 section l) of the Law on Consumers and Users, the right of withdrawal of the consumer and users is not applicable to this contract, as this accommodation service already provides for a specific date or period of execution.

7. Guarantees. 

Accommodation Compliance:

Inversiones Galdana S.L. guarantees the conformity of the accommodation with the descriptions that appear on this website. The photographs shown on the website are of the current state of various accommodations in the same establishment. The accommodation finally booked may not match the photographs, but it will be of the same style, according to the description on the website, and with similar furnishings.

8. Assignment of rights and obligations.

The user may not assign or transfer to third parties the rights or obligations arising from the contracts signed with Inversiones Galdana S.L. without having obtained the prior written consent of the user. 

The waiver by Inversiones Galdana S.L. of any right or action derived from the present conditions of purchase shall in no case imply the waiver of other rights or actions, unless expressly communicated in writing.

10. Jurisdiction and Applicable Law. 

For any type of dispute arising from access to or use of the website, users and Inversiones Galdana S.L., expressly waiving any other jurisdiction that may correspond to them, submit to Spanish law and jurisdiction and to the Courts and Tribunals of Granada.

11. Suggestions, complaints and claims.

Users may address their complaints and claims to Inversiones Galdana S.L. through the contact channels indicated in the "contact" section of these conditions, as well as requesting the mandatory consumer complaint forms.

Complaints will be dealt with by our customer service department as soon as possible and, in any case, within the legally established period. 

An online dispute resolution platform provided by the European Commission is available to the user at the following link: http://ec.europa.eu/consumers/odr/. Through this platform, users can submit their complaints to alternative dispute resolution entities, with quality procedures established for this purpose.
